September 27, 2011Money has bought our politics. Only we the people can take it back. But, HOW?
I have asked a professional lobbyist and a series of Constitutional scholars. They tell me that it will require a large, unrelenting, organized group aligned around a Constitutional Amendment to Get Money Out of politics.
So here is a draft of an Amendment and here is a petition to start the movement.

Our goal is to get a large, unrelenting, organized group to sign on to a petition asking our politicians to ban money in politics. If we can get it big enough, we can use my show on MSNBC as a platform to force this issue to the center of next year’s Presidential debate. Without you I am just a talking head. Our politicians know the problem, too. But they aren’t going to fix the problem because if one of them forfeits money, the others will quickly find that person easy to beat. Instead, all of them must be forced to disarm at the same time. That will only happen if we the people, a large unrelenting, organized group, tell the politicians to Get Money Out.

There are serious legal questions around any Constitutional amendment. What will it do? How extensive can it be? My own sense is that the strongest amendments are a few paragraphs and lay out a simple and strong set of principles. I’ve asked Jimmy Williams, a frequent guest on my show and an experienced lobbyist, to come up with draft text. He’s a lobbyist who has become as disgusted as we are at the fetid stench coming from DC, and he knows as well as anyone how corrupting money can be in our politics. He’s been there.
But the legal questions are frankly small. More importantly, how do we make this happen? I believe we can make this happen by forming an army of Americans who want to get money out, and putting that front and center in 2012. We’ll start with something simple: the voices of 100,000 of us.

I would really like to see the Supreme Court reverse their judgment making corporations people. It is so against nature. And even against logic. If corporations are people, the shouldn't people be corporations? And shouldn't they both then have the same privileges? Bush gave subsidies to companies to move overseas. If it is corporate welfare, why don't they have to show need and low income? And If we had the same privileges, why can't we have subsidies to invest over seas from tax payers and then not share in the profits even if tax payers foot the bill of moving? Isn't that what happen? Too simple or too unjust?

what chance is there when the supreme court passed a rule allowing money to flow freely into the political system ?
They are there to interpret the Constitution. This addition to the Constitution would would have to change the interpretation.
The only way to "undo" a Supreme Court decision is by Constitutional Amendment. That's why this approach is the only one that has any real merit. Check out MoveToAmend.org for more info.

Apparently, the spot on Bashir has generated lots of attempts to sign this petition, I can't even bring it up. But I'll sure sign it for sure. PAC contributions needs to go first. I'm not a parole officer for these politicians and I want to know who gives them money, I don't want it laundered through a PAC.
I've already received 4 panhandling pitches for low end contributions from Dem's today, one from Obama. Not a dime. What gall. With 20million either unemployed or underemployed to ask the public to finance 6-figure jobs takes guts.

You know what I like about the pitches Obama may sent us. That you have to tell your name and your employer as required information. They have as much right to ask those questions. They all ask for money. I have received for both parties and some are for candidates for congress and senators that are not in my state. It is a good thing we do not have to answer. But, I would like to know those policies of Obama that have pass the congress and senate that are hurting the economy. The last time I look the GOP congress was holding the debt ceiling hostage. So, in order to get something the Dems have to give up something else, and McConnell was bragging about how successful was the "holding something hostage". So, it must not Obama's policies who are harming the economy. They are very illogical.

Best way to have a democracy is to give the right to the people, Not to those who pays for it.
Love the concept. Excellent start. Was ready to sign the petition until I saw the last sentence: "Congress shall set forth a federal holiday for the purposes of voting for candidates for Federal office." In my opinion, we have plenty of federal holidays. People who want to vote can vote, whether in person at the polls on election day or by early/absentee voting through the mail. Would like to see that sentence removed and then would be happy to sign the petition.
Are you serious? If there are plenty of Federal holidays what's one more. Are you TRYING to find something to prevent you from signing the thing? Give me a break. Making it a holiday will make it a little easier for people to vote, draw more attention to the importance of the day and take away one more excuse of the lazy. Lots of the newly elected govenors have put in place new rules for voting (Wisconsin, Florida and many more) all to make it harder for people to vote. They have shortened the hours so that people who work for a living will have less time to vote. They are making more rules to regulate how you register to vote. They want you to now come and vote with a picture ID, etc etc give us the Holiday and see how many people show up to vote!!
How are financial contributions by major corporations to political candidates not be a conflict of interest for politicians accepting them? That's always been problematic for me and a major concern. I want money out of politics!

I TOTALLY agree. Our politicians are supposed to be in office to represent US… the people… NOT only the big businesses and corporations who make large contributions. Individuals elect them not businesses and corporations as a whole. I also think they should only serve one term and not be allowed to serve for a lifetime. We need fresh new ideas and innovations.

94% of the time the candidate who raised more money wins! How can any one still believe the USA is a democracy or even a republic? We no longer even have capitalism – an economic system based on fair competition. We now have a government-run corporate plutocracy that buys its politicians, sets its own rules, and the people be damned.
With the decision in Citizens United, this anonymous form of buying politicians could last forever, ending every dream that America once represented. I hadn't even heard until today about one of the new ways of basing chairmanships, not on seniority or expertise, but on who raised the most money from the sector (e.g., banking) which that committee regulates. I have been calling in on Washington Journal for over 5 years on CSPAN calling for True Public Financing of Elections thru ammending the Constitution. Once I even got lucky when Brian Lamb/Producer was hosting that morning. He engaged me quite well on the topic and I feel he would welcome you on his show.

But–one question: will this mean that only the rich can run for office–by that I mean, will those seeking office be able to spend their own money like Ron Johnson in WI did? This needs to be spread out over all potlical blogs on both sides, I believe that liberals and even most Christians conservatives will get behind this….I don't think the unions or the Koch brothers will like it much…also all the potlical think tanks should not be able to lobby congress for large corporations
Public financing. The Unions want the money out . Occupy Wall Street has been occupying Wall Street, doing just that for 14 or 15 days so far and their biggest denouncement is of the stinking corruption of our politics by the heinous greed of corporations. As Americans we no longer are a democracy or even a republic. We no longer even have a capitalistic economy – a system based on fair competition. The U.S. Constitution was shredded with Citizens United. "We the people" was trumped by We the Greatest Donors. We are left with a government-run corporate plutocracy, which anonymously buys its politicians, sets its own rules, and the public be damned.
When 94% of elections are won by the candidate that raised the most money, we need a movement of a hundred million or more fed up with this unworkable system and demands that money be taken out of the equation. I find it fascinating that so many politicians in this country who enjoy the seats of power find it so easy to lie to all of us. To make us fear a government for and by the people. A country steeped in Christian traditions (but not founded as a Christian nation to be sure). I don't believe money in politics is a new think. Money and "nobility" has always amplified the voices of a few while dampening the voices of the many. I don't want my tax dollars spent on certain things and I don't want my taxes to be a higher percentage of my income than a Bill Gates or the Koch Brothers. The only way to give fairness a real shot is campaign reform. It is the solid foundation for everything else. By instituting a separation of money and politics we'll at least give a fair chance for those who actually wish to serve their country and not their wallets to make it in government. To have a president not owned by the banks or big oil. To have politicians who can admit when the government has made mistakes and work to fix them. What a world this could be. Give idealism a real chance. Take the money out of politics. Make it possible for a president to never attend an event to raise money for a campaign. Today's Republican and Democratic parties will spend enough money to buy several third world countries or enough to fix half the bridges that need repair in the midwest. F**k that. Each candidate who meets certain basic requirements gets so much money to make their case to the people and the people vote to decide. We live with the consequences. That's change I can believe in.

Mr. Ratigan is the only news journalist that has the guts to speak to the heart of the matter. If nothing is done about our politicians beholden to the corporate giants, the USA as we know it will seek to exist. Sadly most young adults will never grasp the slow death of the American dream,the consolidation of our media outlets deprive most of our population of the truth. I would love to sign this.. however, I think something should be added to the Amendment where it talks about no person, etc. shall make contribution…. I think you should add "except through a contribution on your Federal Income Tax Return, said contribution to be limited to no more than $500 per person/entity/corporation". If you make it real broad like it is now and do not add that, you cut off a way that they could fund political campaigns. If someone makes that change, I will gladly sign it. It's perfect and something that we need, but I think the language could be changed to not block off a way they CAN get funding, so they will be less reluctant to not want to pass it. Like Congress can pass anything important the way it is going now. I am more than sick of it. Thanks for taking this on.

I totally support this effort. We must save real democracy or we will all go down.
I don't understand the proposed amendment. If "no person, corporation, or business entity of any type, … shall be allowed to contribute money, … to any type of campaign for federal office." This would appear to mean that campaigns would be financed with tax money. If not, then how would campaigns be financed? I could support either public or private (real person) contributions, subject to limitations. It may be difficult to get people to vote for using tax money to pay for campaigns.
The preamble to the Constitution is written "We the people… establish this constitution." It does NOT say "We the corporations, unions, and special interest groups…" It further starts out by creating a structure based on the votes of real persons, and how to allocate the number of Congress members according to the census of REAL PEOPLE.
We need a Constitutional amendment that clarifies that Congress has the right and responsibility to establish limitations on the rights of non-persons (corporations, etc.) to participate in elections. This would allow Congress to set up a system to regulate "non-person" speech, and the effect of their money on elections — to include public financing of elections if desired.
If contributions of ANY kind from ANY source are to be allowed, then the following rules should apply:
1. Instant and complete reporting of the source of contributions, to include the interests they represent. "Citizens for a better America" (i.e., Political Action Committees or PAC's) would be subjected to limitations as a special interest (non-person) group. Contributions that exceed the amount a contributor could reasonably make from his income and savings could be limited.
2. Contributions must be tendered to an independent 3rd agency would also pay all campaign expenses out of the funds received on behalf on specific candidates. The independent agency would post all transactions immediately online for public access, so that all campaign finance reports would be timely as of the date of the last contribution and expenditure. It would also permit auditing the contributions and expenditures to verify accuracy/completeness regarding contributor identity and interest, as well as value received for the expenditure.
Lobbyists could/should be subjected to similar rules.

MONEY IS NOT FREE (unless you are a bank), speech is! Therefore, money cannot equal free speech… As long as our oligarchical economic system is allowed to continue to purchase representation in our corrupted political system, we will never have the true representative democracy that the framers or our Constitution envisioned for us.

Dylan, My wife and I are motivated to do what we can to help in your and Jimmy's effort to end campaign finance money as speech and get money out of politics. We have sent an email blast asking our contacts to join in the amendment campaign. I also sent to our newspaper a plea for others in our community to join in the amendment campaign. The newspaper will often publish my ravings in a guest column. We noticed this has grabbed the attention of quite a few thousands already.
I agree that we should have no more Federal holidays. I work in the emergency dept. and work weekends,holidays and have no problem voting

Yet another reason to pay people to not work? Lose this part!
"How about my…" Covered, organizations legally fall under "business entity", Foreign Governments are already prohibited (They have no Constitutional Protections), The States already hold the power to determine how to elect their Federal Representatives, however, representatives have to be chosen by the People, so no State money either, plus check your State's Constitution.
"How about…" Covered too, "indirect" forms of money, plus can be legislated under: "…campaign contributions…shall not constitute speech.."
"Congress shall…" Just says to make a Federal Holiday for Elections, is there a better thing to celebrate than our Rights, Congress can still declare it an unpaid holiday.
Constitutional Amendments are the foundations of Government and Law, they should not spell out every little detail.

Corporations are pieces of paper, owned by people. If they are US citizens they can go to the polls and vote.One person one vote.

At last, a really intelligent, charismatic populist with a platform-Dylan Ratigan. I agree with your premise about money in politics. Get rid of it at all levels. Let's have publically funded elections at all levels. As a former city council member, I know, firsthand, how expensive it is getting to conduct effective contested campaigns. However, ubiquitious public funding is perhaps not practical so let's start where the festering sore is infected the worse-at the federal level. This systemic corruption needs to be stopped and I can't think of another way to do it. So as the late Gary Gilmore said, "let's do it."

Dear Dylan Ratigan,
I applaud your ‘Get Money Out’ campaign and desperately want to sign it. The most important issue in American politics is the corruption of democracy by the special interest lobby and the obscene money injected into campaigns by special interests groups and individuals.
However, I cannot, in good faith, sign your campaign for a few reasons: First, you will not win the hearts and minds of the public which a manifesto written in ‘legalese’. Second, you have stated that your manifesto was written by a Lobbyist, therefore, with its unclear wording could garner mistrust amongst the population you are trying to reach. Third, there will need to be some Individual contributions to political campaigns, with strict contribution limits. Fourth, until or unless there is a reinstating of the “The Fairness Doctrine” and an overhaul of the “Equal Time Rule” for broadcasting, this manifesto will still allow people and corporations who own TV and radio stations to unduly influence elections and fifth, people who work in low paying jobs will still have to work on federal holidays and therefore voting will be skewed toward the more affluent. Postal or two day (weekend?) voting could solve the low turnout issue, as would fines for not voting, like in Australia.
So in plain English, I think what you are getting at is:
Petition 1
No corporation or business entity, foreign or domestic, shall be allowed to contribute to a federal or local elections, candidates committees or referendums. No foreign individual may contribute to US federal or local candidates, national or local political committees or referendum campaigns. No registered voter may contribute more than their legally allowed donation to a federal or local candidate, national election committee or referendum campaign. All donations will be accepted by the candidate, committee or campaign without condition of influence.
Petition 2
All US citizens and legal residents shall be required by law to vote. Non-compliance will be subject to penalty.

Keep your federal government out of our local business. local elections are not the business of anyone except the citizens affected. Who are you to tell me and my neighbors how to run our elections.
I will support an amendment to my states constitution to limit contributions but it is up to the citizens of my state to decide for ourselves how we want to run our state.

If the national politicians received no money except their salaries, perhaps they would propose/vote for legislation on the basis of objective MERIT instead of seeking to please those who try to bribe them. Please do not give up!! Dylan, I hope this urgent movement will be more wide-spread than just through your excellent program.
Let me OVERsimplify this point…just a little: All the issues this President and we, in this Country, are going through, right now, are a direct result of the corporations and the rich throwing money at the system. Good? Ok. Can not everyone see if we start with this Amendment we can begin to repair this mess?! Do not, at least, the sane have a majority vote in this Country? If not, then we are in some SERIOUS trouble. We can not let things stay the way they are and expect things to get better…THAT is the definition of INSANITY!! We have GOT to set things right, NOW!! Capitalism is the Problem ~ solution: Nationalize ENERGY, BANKING, Health Care, Big AG and Transportation.
How about nationalizing Labor?
This must be a put-on. If the politician is banned from spending any money including his or her own, how does anyone get to know who is running for office? The person can't even use their own money to cover the filing fees for announcing their candidacy. I think this is a great way to eliminate the federal government. There can be no federal politicians or federally elected officials because there can be no candidates to vote for. It is nice to think about that as a possibility but it is still all a lot of nonsense.
The obvious objection to what I have written is that nothing would stop the individual from funding their own campaign. That is, only rich people can run for office. The argument then hinges around the meaning of the word “contribute.” Can a person contribute to their own campaign? I would say that any potential candidate that is donating funds to a campaign for public office makes a personal contribution for the purpose of securing a job for which they can earn a salary. The constitutional amendment would make that illegal. So no one can run for a federally elected office.
You forgot one thing:

… Labor can still contribute as can religions and any other group of people EXCEPT business.

We have become a country for the Corporation by the Corporation rather than the people!! Money truly is the root of all evil when in the hands of the greedy and power hungry.
GetMoneyOut is a substitute for Put Your Vote In! Election Day is the great equalizer. As long as so many Americans have something better to do on that day, we will have politics as usual. The wealthiest(Koch)Americans have but one vote and corporations have zero. I signed the petition, yet realize dusting off my voter's registration card and convincing my acquaintances to register and vote is the real answer.
Mr. Ratigan should have done more to promote this. Literally 1000s of amendments have been proposed to the Constitution and only a handful have been enacted. Amending the Constitution is an uphill battle.
This is a bigger deal than Dylan Ratigan presents it as. He should promote this every chance he gets. He should organize protests throughout the country to get this enacted.
Obviously, he just wanted a quick ratings boost. Shame on you Mr. Ratigan.

I wish you would discuss on a future program the July,2011 audit of the Federal Reserve which disclosed the the Federal Reserve doled out 16 TRILLION $ to both U.S. & foreign financial institutions and, more importantly, how did the Fed. derive such funds. i am definitely all for this petition and more take christianity and their agenda out of politics. i am sick of them pushing their beliefs on everyone. all i see is a message of hate and fear for anyone not willing to agree with them

There's so many things that need fixing with the way our government runs, but this is a step in the right direction, and one that I would think people of all political persuations can support, with the exception of BIG MONEY trying to buy influence.

It looks like the Grand Old Party is out to privatize Medicare and prepare our Post Office for privatzing by reducing emplyees by one third. I am sure some of their rural constituents will be very unhappy after those areas would not be covered due to no profitbility.
All I hear is how the cost of government must be cut. Why do we need 235 Congressmen, their staffs and support. Why not cut the number in half and save half the budget now spent on the House? Why do we need 100 Senators. Why not 50? Would this not also cut the sum of campaign spending considerably?
I readily signed in. Thanks for starting a movement, and urged my friends and acquaintances to do so. politicians will not take actions if it does not threaten their reelection bids to their positions in congress.

I would like to see more media confrontation of the tea party, as an arm of the billionaire Koch brothers rather than anything resembling a grass roots movement. I know tea baggers and they believe they are part of a small government anti corruption movement. On the contrary, it is a buy the government movement, starting with congress and the postal system.
Finally after all the conversations on TV etc. you have hit on the cause of the problem.. if we had gov sponsored elections most of U S problems would go away.
Thank you Dylan for finally saying and DOING something that will change the way this country is being run. If we don't do this to start with, NOTHING we do will help to change it. The amendments are a great start, but we also need to figure out how to fund the process of elections. Possibly have a taxpayer funded, I hesitate to say Government funded, appropriation made to each candidate for use in campaigning. This would allow any candidate to have a fair playing field and we would have access to all qualified individuals. I am an Independent and want the BEST qualified person as my president, not the best Democrat or best Republican.
Use the Ballot Box to “Get the Money Out”
American voters can “Get the Money Out” by voting as follows:
1.Until Congress provides public funding for congressional elections, oust all incumbents by voting for the front running challenger for every open seat. The public funding law must mandate accurate, day by day, public reporting of all private donations. If it does not do that, continue to oust the incumbents until that loophole is closed.
2.After public funding becomes available, never vote for any candidate who accepts private funding.
Note: Public funding is public money that is available in equal amount to all candidates running for the same seat. Private funding is any money that is not public funding. Thus, money given by political parties to their own candidates is private funding.
It is appropriate time to make a few plans for the future and it’s time to be happy. I have read this put up and if I may I want to recommend you few interesting things or suggestions. Perhaps you can write next articles referring to this article. I wish to learn even more issues about it!
